GUANTANAMO BAY:  In 2002, the US created the black hole of the Guantanamo Bay prison, wherein constitutional rights and fundamental due process procedures disappear. Most of the men still held at Guantanamo continue to be imprisoned without charge or trial. The few who have been charged with crimes will never get a fair trial.  

The government office responsible for transfers out of Guantanamo is asleep at the wheel. Over half the remaining detainees have been cleared for release, but progress towards freeing them is unconscionably slow. To name but one example, the US government cleared Toffiq al-Bihani for release 14 years ago, yet his Kafkaesque nightmare continues.


In 2021, the Biden administration stated that it was “certainly our goal and our intention” to close Guantanamo by the end of his term. Three years on, the Biden administration has made only moderate progress. Biden transferred eleven of the forty detainees who were in Guantanamo at the start of his term. There’s still a long way to go - and the clock to the election is ticking.
